These terms of service govern the rights and obligations between the Provider and the user of the Custela service available at custela.com (hereinafter the "Service").
Custela is a cloud (SaaS) platform for tracking AI visibility (GEO). It measures how artificial intelligence models (ChatGPT, Claude, Gemini, Perplexity) mention and cite the user's brand, tracks competitors and sentiment, processes data from Google Search Console and Google Analytics 4, and uses artificial intelligence to prepare content and metadata suggestions that the user applies themselves.
By registering and using the Service, the user confirms that they have read these terms and agree to them.
The user registers with an email and password or through a Google account and provides true and current details. The user is responsible for keeping the login credentials secure and for all activity on their Account. The Provider is entitled to suspend or cancel the Account if these terms are breached.
The Service is provided on a subscription basis according to the current price list on custela.com. The individual plans differ in scope (number of projects, measured prompts, monitored AI models and credits). Prices are stated excluding VAT; value added tax is added at the statutory rate (21%). The subscription is paid in advance for a monthly period.
If a trial period is offered, it automatically converts to a paid subscription once it ends, unless the user cancels before the trial period is over.
Payments are processed by the payment gateway provider Stripe. The subscription renews automatically at the end of each period until the user cancels it. Tax documents are issued electronically and made available in the app or sent by email. If payment is not made, access to the Service may be suspended.
The user may cancel the subscription at any time with effect from the end of the paid period; subscription fees already paid are non-refundable unless stated otherwise. The Provider may terminate the contract with a 30-day notice period. After an Account is canceled, the Provider keeps the data for 90 days (and then deletes it), see Privacy Policy.
The Service includes access to the web application, AI visibility measurement, analytics tools and optional integrations (Google Search Console, Google Analytics 4). The Provider aims for high availability (a target of 99% uptime per month), with the exception of planned maintenance and outages beyond its control. Support is provided by email at info@custela.com.
The Service uses artificial intelligence to measure brand visibility and to prepare content and metadata suggestions. AI outputs and measurement results may contain inaccuracies and change over time; they serve as an informational reference. The user is responsible for reviewing suggestions before using them and for compliance with legislation and third-party rights. The Service makes no changes to the user's website by itself.
The Provider is not liable for outages or changes in third-party services (in particular OpenAI, Anthropic, Google, Perplexity, DataForSEO), for data loss beyond its control, or for the level or development of the visibility or SEO performance of the user's website. The Provider's total liability for damage is limited to the amount of the subscription fees paid by the user over the last 12 months.
The processing of personal data is governed by the Privacy Policy. The Provider acts in accordance with the GDPR (EU 2016/679) and Act No. 110/2019 Sb.
All rights to the Service, its software and its content belong to the Provider. The user receives a non-exclusive, non-transferable license to use the Service for the duration of the subscription. Content generated by the Service for the user may be used by the user on their own websites.
The Provider is entitled to change these terms. It will inform users of material changes at least 30 days in advance by email or by a notice in the app. By continuing to use the Service after the changes take effect, the user agrees to them.
The contractual relationship is governed by the law of the Czech Republic. The parties undertake to resolve disputes primarily by amicable means. A consumer may turn to the Czech Trade Inspection Authority as the body for out-of-court resolution of consumer disputes (coi.cz). Otherwise, the general courts of the Czech Republic have jurisdiction over disputes.
If any provision of these terms is invalid or ineffective, this does not affect the validity of the remaining provisions. These terms constitute the entire agreement between the parties regarding use of the Service. If you have any questions, contact info@custela.com.
